Terms of Service
These terms govern your use of the StoreGem software platform at storegem.com (the "Platform"). They do not replace your storefront's own policies for end customers.
1. Agreement
By creating an account or using the Platform, you agree to these Terms. If you are using the Platform on behalf of a company, you represent that you have authority to bind that company.
2. The service
StoreGem provides tools to create and manage online stores and funnels, including hosting-related features, dashboards, themes, checkout configuration, and integrations. We may change or discontinue features with reasonable notice where practicable.
3. Accounts & eligibility
You must provide accurate registration information and keep it updated. You are responsible for activity under your account and for safeguarding credentials. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform.
4. Subscriptions & billing
Paid plans, trials, renewals, and payment processing are described at checkout and in your billing settings. Fees are charged according to the plan you select. You authorize us and our payment partners to charge your payment method. Taxes may apply where required by law.
5. Acceptable use
You may not use the Platform for unlawful activity, fraud, IP infringement, malware, spam, or to harass others. You may not probe, scan, or test the vulnerability of our systems without permission. We may suspend or terminate accounts that violate these rules.
6. Your content & storefronts
You retain ownership of content you upload. You grant us a license to host, display, and process that content as needed to provide the Platform. You are solely responsible for your storefronts, products, marketing, compliance with applicable laws (including consumer and e-commerce rules), and your own terms and privacy notices for shoppers.
7. Intellectual property
The Platform, branding, and software are owned by StoreGem or its licensors. Except for the rights expressly granted here, no rights are transferred to you.
8. Disclaimers
The Platform is provided "as is" to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation. You use third-party integrations at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, StoreGem and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our aggregate liability arising out of these Terms is limited to the greater of amounts you paid us in the twelve months before the claim or USD $100, except where liability cannot be limited by law.
10. Indemnity
You will defend and indemnify StoreGem against claims arising from your content, your storefronts, your violation of these Terms, or your violation of third-party rights.
11. Termination
You may stop using the Platform at any time. We may suspend or terminate access for breach, risk, or legal requirements. Provisions that by their nature should survive will survive termination.
12. Governing law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the courts of the UAE, unless mandatory consumer protections in your country say otherwise.
13. Changes
We may update these Terms by posting a new version on this page. Continued use after changes become effective constitutes acceptance of the revised Terms.
